Terms and Conditions of Sale

These Terms and Conditions of Sale (hereinafter “T&Cs”) are those of Hugo Degenève (hereinafter “the Seller”), a sole proprietorship with its registered office at 57 rue de Kitzing, 57480 KIRSCH-LES-SIERCK, France, registered in the National Business Register under number 830 164 695 RE 57.

They aim to establish the contractual terms applicable to any purchase made through the website www.plvgcvlt.com by any individual (hereinafter “the Customer”).

1. Application of the T&Cs

The purchase of products offered on the website is subject to these T&Cs. As they may be updated by the Seller and evolve over time, the Customer agrees that the applicable version is the one available online at the time of purchase.

The date of the latest update is always indicated at the top of these T&Cs for easy reference.

2. Order Process

A. Selection of Items by the Customer

While browsing the various product pages on the webite, the Customer may select and confirm the items they wish to order by adding them to their Cart. The cart can be modified at any time using the quantity add/remove options available on the dedicated page.

If the Customer cannot find what they need in the catalog (custom item, specific size, or special requirements), they can contact the Seller via the Contact Form to discuss the feasibility and pricing of the project. Once an agreement has been reached, the Seller will create a private product page and send it to the Customer by email so they can add the item to their cart and place the order.

B. Order Confirmation

The Customer has the option to place an order as a guest or to create a customer account at any time (accessible via the My Accountpage), which will allow them to save their personal information and view details of all their orders.

After verifying the accuracy of the items added to their cart, the Customer must provide and/or confirm their first name, last name, postal address, phone number, and email address.

The Customer agrees to provide accurate, complete, and up-to-date information. The Seller cannot be held responsible for any delivery issues or other problems if incorrect information has been provided by the Customer. However, the Customer may update this information if necessary by sending an email to the Seller as soon as possible, up until the order is shipped.

C. Payment

To complete the order confirmation, the Customer must pay the total amount using one of the available payment methods: credit card, PayPal, Google Pay, or Apple Pay. Once the required information has been entered and the “Place Order” button clicked, the order will be considered confirmed.

A confirmation email containing the customer invoice will be sent within a few days to the email address provided.

3. Production Time and Delivery Terms

A. Production

The products ordered on the webite are handcrafted and made to order by the Seller once the order has been confirmed.

The average production time is 10 days, and the Seller undertakes to make every effort to meet this timeframe. However, if a case of force majeure should disrupt and extend this period (such as a high volume of orders, wood stock shortages, or illness), the Customer will be informed by email and may decide whether the new timeframe proposed by the Seller is acceptable. If the Customer does not agree, the order may be canceled, and a full refund will be issued within a maximum of 14 days.

B. Delivery

Le Vendeur utilise le service national de livraison Laposte pour l’acheminement des commandes, avec un numéro de suivi qui sera communiqué au Client par e-mail le jour de l’expédition. Les frais de livraison pour les écarteurs sont tarifés de la manière suivante : 3€ pour la France (offerts à partir de 70€ de commande) et 7€ pour le reste du monde (offerts à partir de 100€ de commande)

Once the order has been shipped, the Seller cannot be held responsible for any delivery delays or lost parcels. However, the Customer may contact their local postal service to request information using the tracking number provided by the Seller.

Estimated delivery times vary depending on the destination country and are available on the Laposte website. Delivery usually takes around 2 to 3 business days for mainland France and approximately 1 to 2 weeks for other countries.

4. Prices

Product prices are indicated in euros, excluding taxes and shipping fees. Shipping costs will be updated in the cart once the address has been entered.

If the Customer wishes to order a custom project not listed in the catalog, the price will be provided during the email exchange with the Seller. The Seller will then include this price on a private product page and send the link to the Customer so they can add it to their cart.

Special offers and promotions are only valid for orders that have been fully paid during the promotion period. The Seller reserves the right to cancel any order that has not been paid within this timeframe.

Orders shipped outside of France may be subject to taxes and/or customs duties upon arrival in the destination country. It is the Customer’s responsibility to be aware of and pay these fees, and they are encouraged to consult the relevant authorities in their country before placing an order.

5. Accuracy of Information

A. Incorrect Information

The Seller undertakes to keep product descriptions and prices as up-to-date as possible. However, they reserve the right to correct any pricing errors and to modify or update any information that may be considered incorrect at any time.

B. Photographs and Order Appearance

The photographs and visual simulations provided with the products are for illustration purposes only and do not guarantee the exact appearance of the items ordered. As wood is a highly variable material, each piece is unique, with its own grain and color. The same applies to pyrography, which may vary depending on the size, wood type, and the fact that some designs are entirely hand-drawn.

Before placing an order, the Customer may request from the Seller, if needed, a photograph of the pieces of wood that will be used for their order, as well as a sample of the pyrography design in the desired size and wood type. Therefore, the Customer cannot request a refund after production due to aesthetic variations in the wood or a pyrography result that does not meet their expectations.

C. Allowable Variations of Wooden Plugs

The plugs are individually handmade, and the wood may slightly expand or contract depending on the surrounding humidity. For this reason, the Seller allows a maximum tolerance of half a millimeter from the ordered diameter. If such a variation occurs, it should have no impact on the Customer’s comfort, provided they follow the usage recommendations included with their order.

6. Responsability

A. Wooden Plugs and Allergies

The Seller makes every effort to minimize the risk of allergic reactions: selecting wood species that come into direct contact with the lobe, finely sanding surfaces, and using vegetable oil and wax for the finish. Despite these precautions, there is no zero-risk guarantee, and each individual may react differently. It is therefore recommended to remove the plugs at the first sign of an allergic reaction (redness or irritation) and consult a doctor immediately if necessary. The Seller cannot be held responsible for any potential allergic reaction, and this cannot be used as a reason for a refund.

B. Accuracy of Delivery Information

The Customer is responsible for the accuracy of the delivery information provided to the Seller when placing their order. The Seller cannot be held liable for misdelivery or a lost parcel if the provided shipping address is incorrect. If a misdirected shipment is returned to the Seller, the Customer must pay the shipping costs again (or in full if they were previously free) to have the order resent to the correct address. If the shipment is permanently lost, a new order will need to be placed.

C. Foreign Legislation

The Seller cannot be held responsible for the non-compliance of its products with foreign legislation. The Customer is therefore advised to consult the relevant authorities in their country before placing an order.

7. Right of Withdrawal

A. Terms of Application

The Customer has 14 days from the receipt of their order to exercise their right of withdrawal.

Note: This right does not apply to body jewelry (plugs and tunnels, even if unworn) for hygiene reasons, nor to products that have been custom-made or personalized at the Customer’s request (custom designs, off-catalog variations, specific pyrography, etc.).

However, if the withdrawal request is due to an error in size or model on the part of the Seller, the items can of course be refunded or exchanged. In such cases, both the return shipping costs and the products will be fully refunded within 14 days once the Seller has received the order and verified any errors. The Customer will be notified by email.

B. Withdrawal Process

To initiate the withdrawal process, the Customer must contact the Seller via the Contact Form or by email at plvgcvlt@gmail.com, providing their order number and explaining the reason for withdrawal. The Customer must then return the order at their own expense to the postal address provided, ensuring that the products are properly packaged and returned in perfect condition. The Seller reserves the right to deduct any loss of value from the refund if the returned order arrives damaged or incomplete.

The refund will be issued within 14 days from the date the Seller receives the returned order, provided all withdrawal conditions have been properly met.

C. Returns from Another Country

If an order is returned from abroad, the Customer must ensure that the shipment is marked “RETURNED GOODS” to avoid any customs fees. The Seller reserves the right to refuse a return if customs charges are incurred to recover the returned order.

The Seller undertakes to respond as quickly as possible and to first seek an amicable solution if the contact concerns an issue related to an order.

9. Force Majeure

The Seller’s liability cannot be held responsible if the non-performance or delay in the performance of any of its obligations under these T&Cs results from a case of force majeure.

10. Competent Court

Any dispute relating to the interpretation or enforcement of these T&Cs is governed by French law. Failing an amicable resolution, legal proceedings may be initiated to settle the dispute.
