General Terms and Conditions of Sale

The present General Terms and Conditions of Sale (hereinafter "GTC") are those of Hugo Degenève (hereinafter "the Seller"), a Sole Proprietorship whose registered office lies at 57 rue de Kitzing, 57480 KIRSCH-LES-SIERCK in France, registered to the Registre National des Entreprises under the number 830 164 695 RE 57.

The purpose of these terms is to establish the contractual conditions applied when making a purchase through the website www.plvgcvlt.com (hereinafter "the Site") by any person (hereinafter "the Client").

1. Application of the GTC

The purchase of products offered on the Site is subject to these GTC. As these may be updated by the Seller and evolve over time, the Client agrees that the current version corresponds to the online version at the time of their purchase.

The date of the last update is always indicated at the header of these GTC for easy identification.

2. Ordering Procedure

The website www.plvgcvlt.com serves as a showcase to present the range of products available for purchase. It does not have a shopping cart or direct purchase option, as found on other e-commerce sites.

 

A. Price inquiry

To place an order, simply contact the Seller through the "Contact" section of the Site, indicating the list of desired products and options, or by filling out the "Price Request" form. After assessing the feasibility of the project, the Seller will provide the exact price for each product in their email response, along with the shipping costs and the total order amount.

 

B. Payment

If the price is acceptable to the Client, they can inform the Seller of their preferred payment method.

For payment via bank transfer, the Seller will provide their IBAN to the Client, who can then proceed with the bank transfer.

For payment through Paypal, the Seller will send the Client an email summarizing the description and amount of the items and shipping costs, along with a Paypal link to pay the order.

The order is considered validated upon notification of Paypal payment or when the bank transfer is successfully received in the Seller's bank account.

 

C. Invoicing

If not previously provided, billing information will be requested by email from the Client. Billing and shipping addresses are defaultly considered identical, but the Client can specify a different delivery address if needed.

The Seller cannot be held responsible for delivery issues if incorrect information is provided by the Client. However, the Client can modify this information until the order is shipped by sending an email to the Seller as soon as possible.

A paper invoice will always be sent with the order. If necessary, it can also be transmitted by email upon request after the payment of the order.

3. Manufacturing Time Period and Delivery Terms

A. Manufacturing

The products ordered on the Site are handmade and custom-made by the Seller. The average manufacturing lead time is around 10 days, but it may vary depending on the number of items ordered, the complexity of their production, the overall order volume, and potential material replenishment.

The current manufacturing lead time will always be specified to the Client during the discussion preceding payment, allowing them to decide whether to place the order or not.

It is important to note that the product's manufacturing process will begin only after the payment is validated (see Part 2.B of the GTC).

The Seller commits to doing everything possible to meet the announced lead time, but his responsibility cannot be engaged if a force majeure event disrupts the manufacturing process, for example a defective piece of wood that cannot be detected before starting production.

Pictures of the final result will be systematically sent by email to the Client before shipment to make sure it meets their expectations, allowing for potential modifications and adaptations if the project allows it. If this email receives no response within 24 hours or if the requested modifications are too extensive and cannot be accommodated, the order will be shipped as it is.

 

B. Delivery

Information regarding delivery costs and methods is indicated on each product page, and the amount of these costs will be confirmed during the discussion preceding the order validation.

The Seller uses the French national postal service Laposte for order delivery, with a tracking number communicated to the Client by email on the day of shipment.

Once the order is shipped, the Seller cannot be held responsible for any delivery delays or loss of parcels. However, the Client can contact their local postal service for information using the tracking number provided by the Seller.

Indicative delivery times vary depending on the destination country and are available on the Laposte website. It is approximately 2 to 3 working days for Metropolitan France and about 1 to 2 weeks for other countries.

4. Prices

Prices are indicated in euros, excluding tax. As orders are entirely custom-made and customizable, the price charts on product pages serve as a base price and may evolve based on the project's complexity and the chosen wood types. Therefore, the final price will be communicated to the Client only after an email exchange to precisely establish the Client's needs, feasibility, and the order amount.

Special offers and promotions are valid only for orders that have been fully paid during the promotion's validity period. The Seller reserves the right to cancel an order that has not been paid within this timeframe.

Orders leaving French territory may be subject to taxes and/or customs duties upon arrival at their destination. Knowledge and settlement of these taxes are the responsibility of the Client, who is encouraged to inquire about them with the competent authorities in their country before placing an order.

5. Compliance of Information

A. Incorrect information

The Seller is committed to keeping product description and pricing information as up-to-date as possible. However, the Seller reserves the right to correct any pricing errors and to modify or update information that may be considered inaccurate at any time.

 

B. Pictures and order result

Pictures and simulations accompanying the products serve as illustrations only and do not guarantee the exact appearance of the ordered products. As wood is a material with highly variable appearance, each manufactured piece is unique and has its own veining and color. The same applies to pyrographies, the appearance of which may vary depending on size, wood type, and the fact that some are entirely hand-drawn.

Before placing an order, the Client can request from the Seller a picture of the wood pieces that will be used for their order and an example of the pyrography rendering in the desired size and wood type. Therefore, it is not possible for the Client to request a refund after production due to an aesthetic wood variation or a pyrography rendering that does not suit them.

 

C. Margin of error for wooden plugs

Wooden plugs are individually handcrafted, and wood can slightly change based on ambient humidity. Therefore, the Seller allows a margin of difference of up to half a millimeter from the ordered diameter. This margin, if it were to exist, should have no impact on the Client's comfort if they follow the usage recommendations provided with their order.

6. Responsability

A. Wooden plugs and allergies

The Seller commits to doing his best to minimize the risks of allergic reactions : choice of wood types in direct contact with the lobe, very fine sanding of surfaces, and using vegetable oil and wax for finishing. Despite all precautions, zero risk does not exist and each body may react differently. It is recommended to remove plugs at the slightest sign of an allergic reaction (redness or irritation) and consult a doctor immediately if necessary. The Seller cannot be held responsible for a potential allergic reaction, and it cannot be a reason for a refund.

 

B. Accuracy of delivery information

The Client is responsible for the accuracy of the delivery information provided to the Seller at the time of the order. The Seller cannot be held responsible for a delivery error or a lost parcel if the provided delivery address proves to be incorrect. If the lost shipment returns to the Seller, the Client will need to pay again the shipping costs to resend the order to the correct address. If, on the other hand, the shipment is definitively lost, a new order will need to be placed.

 

C. Foreign legislation

The Seller cannot be held responsible for the non-compliance of their products with foreign legislation. Therefore, the Client is advised to inquire with the relevant authorities in their country before placing an order.

7. Right of withdrawal

A. Application modalities

The Client has 14 days from the receipt of their order to exercise their right of withdrawal.

Warning : this right does not apply to body jewelry (plugs and tunnels) for hygiene reasons, nor to products that are customized to the Client's specifications (non-catalog patterns or variations, specific pyrography, etc.).

However, if the withdrawal request is due to an error in size or design on the part of the Seller, the items can of course be refunded or exchanged. In this case, return costs and products will be fully refunded within 14 days once the Seller has received the order and verified any errors. The Client will be notified by email.

 

B. Withdrawal process

To initiate the withdrawal process, the Client must contact the Seller through the Contact form or by email at plvgcvlt@gmail.com, indicating their order number and detailing the reason for withdrawal. They must then return the order at their expense to the postal address provided, ensuring the products are well-packaged and returned in perfect condition. The Seller reserves the right to deduct any loss of value during the refund if the order arrives damaged or incomplete.

The refund will be made within 14 days from the date of receipt of the order by the Seller, if all withdrawal conditions have been properly followed.

 

C. Return from a country other than mainland France

If an order is returned from abroad, the Client should ensure that the shipment is labeled as "RETURNED GOODS" to avoid any customs charges. The Seller reserves the right to refuse a return if customs charges are incurred to retrieve the returned order.

The Seller commits to respond as soon as possible and, in the first instance, to seek an amicable solution if the contact concerns an issue related to an order.

9. Force majeure

The Seller's responsibility cannot be incurred if the non-execution or delay in the execution of any of its obligations described in these CGV results from a force majeure event.

10. Competent court

Any dispute relating to the interpretation and execution of these GTC is subject to French law. In the absence of an amicable resolution, a judicial procedure may be initiated to settle the dispute.
